N.J. Judge Refuses to Dismiss Contract Claims Against Brazilian Company in Retrocessional Dispute

CAMDEN, N.J. — A New Jersey federal judge ruled that he has jurisdiction over contract claims asserted against a Brazilian company in a reinsurance action because the company purposely availed itself of the privilege of doing business in the state through its direct contacts with its New Jersey broker.

However, in the Feb. 8 order, Judge Jose L. Linares of the U.S. District Court for the District of New Jersey further ruled that he does not have jurisdiction over tort claims asserted against the company because they do not arise from the company’s contacts with New Jersey.
