Pa. Court Affirms Order Dismissing Asbestos Claims as Time-Barred

HARRISBURG, Pa. –– A Pennsylvania appellate court has affirmed an order dismissing asbestos claims as time-barred, rejecting the plaintiffs’ position that an earlier diagnosis of asbestosis was incorrect.

In a Jan. 12 order, the Pennsylvania Superior Court found that the accuracy of a 2003 diagnosis was no longer relevant.

The plaintiffs asserted the claims on behalf of Vincent Gatto, who was allegedly exposed to asbestos-containing products while employed as a brick mason. As a result of the exposure, Gatto developed mesothelioma, the plaintiffs said.
