Benzene Defendant Opposes Motion for Summary Judgment on Issue of General Causation

DAVENPORT, Iowa –– A defendant in a benzene case has opposed the plaintiff’s motion for summary judgment on the issue of general causation, saying that the motion “provides a superficial view of the factual and legal standards for establishing general causation in a toxic tort case.”

In a Dec. 8 opposition brief filed in the U.S. District Court for the Southern District of Iowa, defendant Archer-Daniels-Midland Co. maintained that granting the motion would do “little” to save time and resources in the matter and would, ultimately, be prejudicial to the defendants.
