Benzene Defendants Back 5th Circuit’s Decision to Not Accept Amicus Brief from CERT

NEW ORLEANS –– Defendants have opposed an amicus party’s attempt to file a brief in a benzene dispute pending before the U.S. Court of Appeals for the 5th Circuit, saying that nothing in the proposed belief could affect or aid the appellate court’s decision.

In a Dec. 7 opposition brief, the benzene defendants said further that the 5th Circuit is not ill equipped to decide the relevant issues “without the benefit of input from scientists and physicians.”
