9th Circuit Reverses Award of Summary Judgment Entered in Favor of 3 Asbestos Defendants

PASADENA, Calif. –– The U.S. Court of Appeals for the 9th Circuit has reversed an award of summary judgment entered in favor of three asbestos defendants, finding that the federal court had erred when it found that the plaintiffs had failed to establish that the decedent was exposed to asbestos fibers in the defendants’ electrical products.

In the Nov. 13 order, the 9th Circuit did note, however, that it was unclear from the record whether the federal court determined the issue of causation on another ground other than product identification and, as such, remanded the case for further proceedings.
