Synthes Awarded Summary Judgment on LPLA Claims in Louisiana Clavicle Plate Action

NEW ORLEANS — A federal judge has awarded Synthes Inc. summary judgment in an LCP clavicle plate action, ruling that the plaintiff failed to support his Louisiana Product Liability Act claims with sufficient evidence and that his non-LPLA claims are barred by state law.

On Nov. 4, Judge Martin C. Feldman of the U.S. District Court for the Eastern District of Louisiana further ruled that the plaintiffs’ claims arising from his first implantation surgery are time-barred because he should have been aware of his cause of action more than a year before filing suit.
