Calif. Appellate Court Publishes Recent Opinion Entered in Benzene Case

LOS ANGELES –– A California appellate court has opted to publish its recent decision reversing an award of summary judgment in which it found that the benzene defendant had not established that its mineral spirits weren’t inherently dangerous, according to a recent docket entry.

As a result, the California Second District Court of Appeal’s Oct. 7 opinion is no precedential. The order was reentered on Oct. 30 with a notation that it was published.

In its opinion that appellate court concluded that the defendant was not shielded under the raw material or component parts doctrine.
