Fla. Judge Overseeing M2a Magnum Hip Replacement Cases Says Information on M2a38 System Discoverable

SARASOTA, Fla. –– A magistrate judge has weighed in on a dispute over whether information on a separate hip implant system is discoverable, saying that since the implanted system is “substantially similar” to a previous system manufactured by Biomet, the plaintiffs can seek the production of documents on complaints arising out of that hip implant as well.

In an Oct. 26 recommended order, Magistrate Judge Deborah Bailey suggested that the Florida 12th Judicial Circuit Court for Sarasota County grant the plaintiffs’ motion to compel.
