Trial Underway in NexGen Knee Implant Case; Zimmer Moves for Judgment as Matter of Law

CHICAGO –– Zimmer has filed a motion for judgment as a matter of law in a NexGen Knee Implant MDL case that began trial recently, arguing that the plaintiff had “failed to introduce sufficient evidence for her to prevail on her claims.”

According to the U.S. District Court for the Northern District of Illinois docket, jury selection in the bellwether case began on Oct. 9. Opening statements were heard Oct. 13.

Bellwether plaintiff Kathy Batty alleged in her complaint that she underwent total knee replacements on both knees in April 2009 in effort to help her degenerative joint disease. …
