Zimmer Moves to Apply Hague Convention in Taking of Swiss Evidence

NEWARK, N.J. - Zimmer Holdings Inc. and Zimmer Inc. have moved for a protective order in the Durom Cup multidistrict litigation, asking that the provisions of the Hague Convention be applied to the production of Swiss evidence sought by plaintiffs. In re: Zimmer Durom Hip Cup Products Liability Litigation, 2:09-cv-04414-SDW-MCA, MDL No. 2158 [Master Case No. 09-4414] (D. N.J.).

The Zimmer defendants filed the motion Jan. 9, saying that applying the provisions of the Convention on the Taking of Evidence Abroad in Civil or Commercial Matters, the "Hague Convention," would protect it from civil or criminal liability in Switzerland.
