ASR Plaintiffs Who Withdraw 20 Days After Filing Will Need Defense Stipulation

CLEVELAND - Plaintiffs who decide to dismiss their claims in the DePuy ASR Hip Implant MDL will need defendants to stipulate to a voluntary dismissal if they file more than 20 days after submitting a short-form complaint, the presiding judge said in his latest case management order. In re: DePuy Orthopaedics, Inc. ASR Hip Implant Products Liability Litigation, No. 1:10-md-2197 (N.D. Ohio).

Judge David A. Katz, who oversees the DePuy ASR MDL in the U.S. District Court for the Northern District of Ohio, noted the need for a defense stipulation in entering Case Management Order No. 8 on Sept. 9.
