Texas Plaintiffs Move to Vacate Conditional Transfer to DePuy ASR MDL

TOLEDO, Ohio - Plaintiffs in a Texas hip implant case are among dozens who have asked the Judicial Panel on Multidistrict Litigation to vacate conditional transfer orders that would consolidate their claims with similar cases in the federal MDL while motions to remand are pending in the transferor courts. Banks, et al. v. DePuy Orthopaedics, Inc., et al., [No. 3:11-cv-00718, N.D. Texas] MDL No. 2197 (N.D. Ohio).

The Judicial Panel recently denied a similar motion by plaintiffs in 16 other cases awaiting transfer to MDL 2197 (In re: DePuy Orthopaedics, Inc. ASR Hip Implant Products Liability Litigation).
