Trident Hip Replacement Claims are Preempted, Judge Rules

LOUISVILLE, Ky. - A federal judge has dismissed common law claims brought against a hip replacement manufacturer, ruling that they were not pleaded with the requisite particularity in order to be deemed "parallel claims" under Riegel v. Medtronic. White v. Stryker Corp., No. 10-544 (W.D. Ky.).

In a March 25 order, Judge John G. Heyburn II of the U.S. District Court for the Western District of Kentucky explained that the plaintiff's amended complaint "does not assert either a Premarket Approval-specific standard or a good manufacturing practices regulation, the violation of which might form the basis for a state law action."
