Georgia Federal Court Retains Jurisdiction Over Hip Implant Case

ATLANTA - A Georgia federal judge has refused to remand a DePuy ASR Hip Implant Device case to state court, ruling that the plaintiff failed to bring a viable claim against the sole Georgia defendant, a medical device distributor. Askew v. DC Medical LLC, et al., No. 11-1245 (N.D. Ga.).
Judge William S. Duffey Jr. of the U.S. District Court for the Northern District of Georgia ruled that plaintiff failed to discredit evidence that at the time of her implantation, DC Medical LLC was not in possession of evidence that the ASR device causes serious injuries.
