Judicial Panel Refuses to Vacate 16 Conditional DePuy ASR Transfers

WASHINGTON, D.C. - The Judicial Panel on Multidistrict Litigation has denied a motion to vacate the conditional transfer of 16 actions to the DePuy Orthopaedics Inc. ASR Hip Implant Products Liability Litigation, saying pending motions to remand can be decided by the transferee judge. In re: DePuy Orthopaedics, Inc. ASR Hip Implant Products Liability Litigation, MDL No. 2197 (N.D. Ohio).

The panel entered its order on May 19, noting that DePuy Orthopaedics Inc., Johnson & Johnson and other defendants opposed the motion.

Plaintiffs in the 16 cases opposed transfer to MDL 2197, which has been assigned to Judge David Katz …
