Zyprexa Injury Claims are Time-Barred, Judge Rules

NEW YORK - Claims that Zyprexa caused a man to contract diabetes and pancreatitis are time-barred because they were filed after the expiration of New York's three-year statute of limitations, a New York federal judge has ruled. Dixon v. Eli Lilly & Co., Nos. 04-MD-1596, 09-CV-1012 (E.D. N.Y.).

On May 19, Judge Jack B. Weinstein of the U.S. District Court for the Eastern District of New York further ruled that the limitations period was not tolled because "sufficient scientific knowledge to ascertain the cause of injury was not available within the three-year limitations period."
