Name-Brand Manufacturers Prevail in Florida Reglan Injury Suit

TAMPA, Fla. -A Florida federal judge has granted two name-brand drug manufacturers summary judgment in a Reglan injury suit, ruling that because the plaintiff did not ingest the drugs manufactured by the defendants, they owed no duty of care. Howe v. Wyeth Inc., et al., No. 8:09-CV-610-T-17AEP (M.D. Fla.).
On April 26, Judge Elizabeth A. Kovachevich of the U.S. District Court for the Middle District of Florida further ruled that there was no privity between the defendant drug manufacturers and the plaintiff or the manufacturers of the drug that was ingested.
