Reinsurers May Proceed in U.K.; Cedents May Proceed in U.S.

KANSAS CITY, Mo. - A Missouri federal judge has refused to enjoin reinsurers from proceeding against CCC Casualty Co. in a parallel proceeding in England, ruling that CCC has failed to demonstrate "any vital American interest at stake." CCC Casualty Co. v. AXA Global Risks (UK) Ltd., et al., No. 09-00335 (W.D. Mo.).

In an April 2 order, Judge Fernando J. Gaitan of the U.S. District Court for the Western District of Missouri also denied the reinsurers' motion to dismiss the United States action, ruling that the "first-filed" rule does not apply to disputes pending in two different sovereignties.
