Federal Judge Remands Yaz/Yasmin Case to State Court

LOS ANGELES - A California federal judge has remanded a Yaz/Yasmin action to California state court, ruling that the defendants failed to prove that McKesson Corp., a California corporation, was fraudulently joined. Mandernach v. Bayer Corp., No. 09-02306 (C.D. Calif.).

On Feb. 8, Judge Jacqueline H. Nguyen of the U.S. District Court for the Central District of California further ruled that the complaint establishes a connection between McKesson's role as distributor of the drugs and the plaintiff's injury.

In November 2007, Mandernach, who had been taking Yaz or Yasmin, suffered a stroke resulting in permanent physical deficits and sequelea. At …
