Liver Damage Case Dismissed for Lack of Credible Evidence

NEW YORK - A New York state judge has dismissed a suit alleging a link between Tylenol and cirrhosis of the liver, ruling that the plaintiff failed to present scientifically acceptable evidence linking the disease with the approved daily dosage of the drug. Ratner v. McNeil-PPC Inc., No. 48820/02 (N.Y. Sup., Kings Co.).

On Jan. 19, Judge Leon Ruchelsman of the Kings County Supreme Court determined that the affidavits of plaintiff's experts failed to meet the standard set forth in Frye v. United States (293 F. 1013 D.C. Cir. [1923]).
