Federal Judge Remands Trasylol Injury Action to State Court

BENTON, Ill. - An Illinois federal judge has remanded a Trasylol personal injury case to state court, ruling that the case is not removable to federal court under the Class Action Fairness Act of 2005 because it lacks the requisite number of plaintiffs. Lecker v. Bayer Corp., et al., No. 09-991 (S.D. Ill.).

In a Jan. 13 order, Judge G. Patrick Murphy of the U.S. District Court for the Southern District of Illinois further ruled that federal jurisdiction is not created by defendants' allegations of fraudulent misjoinder.

Eighteen plaintiffs sued Bayer Corp., Bayer Healthcare LLC and Bayer Healthcare Pharmaceuticals Inc. …
