Ambien 'Sleep-Driving' Action was Untimely Filed, Federal Judge Rules

AUSTIN, Texas - A Texas federal judge has dismissed an Ambien "sleep-driving" action, ruling that the two-year statute of limitations was not tolled because the plaintiff failed to establish that he was legally disabled at the time his cause of action accrued. Bowman v. Sanofi-Aventis US, No. A-09-CA-192 (W.D. Texas).

Judge Sam Sparks of the U.S. District Court for the Western District of Texas ruled that the plaintiff failed to prove that he had an "unsound mind" at the time of the "sleep-driving" incident.
