MINNEAPOLIS - In a Premarin/Prempro injury case filed in Minnesota by an out-of-state resident, the Minnesota statute of limitations applies, even though the event giving rise to the claims did not occur in that state and took place before Aug. 1, 2004, the Minnesota Supreme Court has ruled. Fleeger v. Wyeth, No. A08-2124 (Minn. Sup. Ct.).

In a decision handed down on Sept. 3, the Minnesota Supreme Court, led by Chief Judge Eric J. Magnuson, reasoned that the common law is clear and that statutes of limitation are "procedural without exception."
