Federal Judge Tosses Trasylol Marketing Lawsuit

MIAMI - A Florida federal judge has dismissed a Trasylol marketing suit brought by a healthcare fund against Bayer Corp., ruling that the complaint did not meet the specificity requirements of the federal Racketeer Influenced Corrupt Organizations Act. Southeast Laborers Health and Welfare Fund v. Bayer Corp., No. 08-1928 (M.D. Fla.).

On July 30, Judge Donald M. Middlebrooks of the U.S. District Court for the Southern District of Florida further ruled that the complaint, filed by the Southeast Laborers Health and Welfare Fund, does not meet the pleading requirements of the New Jersey Consumer Fraud Act (NJCFA).
