Access General Entities Ask Judge to Toss Complaint

DOCUMENTS
  • Motion to Dismiss
  • Second Amended Complaint
  • Supplemental Reply

CHICAGO - A group of reinsurance administrators have moved an Illinois federal court to dismiss Swiss Reinsurance America Corp.'s second amended complaint, which accuses them of mishandling claims in connection with two reinsurance programs. Swiss Reinsurance America Corp. v. Access General Agency of California, No. 07 C 3954 (N.D. Ill.).

In an Oct. 31 filing, Access General Agency Inc., Access Claims Administrators Inc. and Access Insurance Agency of California Inc. argued that Swiss Re failed to properly plead an alter ego theory, failed to state which entity committed which alleged breach, and failed to plead fraud with the requisite particularity.
