Federal Judge Bars Plaintiffs From Adding GSK Entities to Suit

OKLAHOMA CITY - In a Paxil injury case, an Oklahoma federal judge has denied the plaintiffs' request to add as defendants GlaxoSmithKline's parent company and GSK's research and development division, ruling that neither entity was a "manufacturer" of the drug and thus cannot be held liable under Oklahoma law. Hayes v. GlaxoSmithKline, No. 07-0682 (E.D. Okla.).

The Nov. 20 opinion was issued by Chief Judge Claire V. Eagan of the U.S. District Court for the Eastern District of Oklahoma.
