DALLAS - A plaintiff who sued the maker of Accutane nearly 20 years after he ingested the drug is barred by the Texas statute of repose from asserting product liability claims against the manufacturer, a federal judge has ruled. Hyde v. Hoffmann-La Roche Inc., et al., No. 04-1473 (N.D. Texas).
Judge Jane J. Boyle of the U.S. District Court for the Northern District of Texas ruled Sept. 10 that George Hyde waited too long to file his case after undergoing surgery he said was related to his Accutane-induced injury.
