Builders Mutual Insurance Asks 4th Circuit to Adopt Reasoning Outlined in Travco

RICHMOND, Va. –– An insurance company has urged the U.S. Court of Appeals for the 4th Circuit to reverse a District Court ruling that found language in a homeowners’ policy relating to pollutants was ambiguous, pointing to the Virginia Supreme Court’s recent decision that sulfur-producing drywall was unambiguously excluded from coverage.

The 4th Circuit had asked the parties to file supplemental briefing as to the effect of the recent Virginia Supreme Court decision in Travco Ins. Co. v. Ward, to the instant appeal.
