4th Circuit Affirms Judgment for Pneumo Abex in Asbestos Case, Rejects Challenges to Jury Instructions

RICHMOND, Va. –– The 4th Circuit U.S. Court of Appeals has affirmed a judgment entered in favor of Pneumo Abex at the conclusion of an asbestos trial, rejecting the plaintiffs’ argument that the jury was improperly instructed on third-party negligence.

In a Dec. 14 opinion, the 4th Circuit stated that the jury was “adequately instructed on the applicable legal principles, and its verdict is entirely consistent with those principles.”

Plaintiffs Erik Ross Phillips and Tina Landers asserted the claims, contending that Erik Ross Phillips had developed mesothelioma as a result of occupational exposure to asbestos fibers in brake linings …
