The New Toxic Control Substances Act: A More Muscular Regulatory Approach Likely to Drive New Litigation
• Under the revised law, EPA now has authority – subject to judicial review - to require more testing and to regulate chemicals out of production if they pose an unreasonable risk to the public and, for the first time, it is not to consider a cost-benefit analysis in doing so. We can expect legal challenges from the various stakeholders to this more robust rulemaking, as well as to the law’s preemption of some state chemical regulations.
