Del. Judge Refuses to Reconsider Ruling that Superstorm Sandy Losses Subject to $25 Million Flood Sub-Limit

WILMINGTON, Del. — A Delaware judge has denied an insurer’s motion to reconsider his ruling that a $25 million flood sub-limit in a commercial policy applies to Superstorm Sandy-related claims for time element losses.

On May 24, Judge Eric Davis of the Delaware Superior Court said he “did not overlook any precedent or controlling legal principles or misapprehend the law or the facts such as would affect the outcome of the decision” and that in challenging the ruling, the insurer merely rehashed arguments it made in earlier motions.
