Claims Against Irish Manufacturer in Transvaginal Mesh Case Dismissed for Lack of Jurisdiction

CHARLESTON, W. Va. — A West Virginia federal judge has dismissed claims asserted against an Irish manufacturer in a transvaginal mesh case for lack of jurisdiction, ruling that the company lacks the requisite contacts with the state in which the action was originally filed.

In a Feb. 5 order, Judge Joseph R. Goodwin of the U.S. District Court for the Southern District of West Virginia reasoned that the defendant had no control over where in the United States its product might end up and, therefore, could not predict that it would be sold in New Jersey.
