JPML Denies Plaintiffs’ Second Request to Consolidate Cymbalta Withdrawal Actions

WASHINGTON, D.C. — The Judicial Panel on Multidistrict Litigation has once again refused to create a coordinated docket for lawsuits accusing Eli Lilly & Co. of hiding the risk of injuries related to Cymbalta withdrawal, explaining that the procedural posture of the actions “vary significantly.”

In the Oct. 9 order denying the plaintiffs’ petition for consolidation, the JPML further noted that there has not been a significant increase in the number of unique counsel and common discovery has already taken place in the earlier-filed actions.
