Federal Judge Allows Warning, Design Defect Claims to Proceed in Stryker Accolade Hip Action

LAKE CHARLES, La. — A Louisiana federal judge has refused to dismiss claims of failure to warn, defective design and breach of warranty asserted in a Stryker hip implant case, ruling that they meet the Louisiana Product Liability Act’s pleading requirements.

In an Aug. 26 order, Judge James T. Trimble Jr. of the U.S. District Court for the Western District of Louisiana found the plaintiff has sufficiently alleged that the metal-on-metal design of his Accolade hip system generated metal debris that caused him to suffer numerous injuries.
