Ala. Supreme Court Declines to Weight in on Premises Owner Liability, Causation Standard for Multiple Exposures

BIRMINGHAM, Ala. –– The Alabama Supreme Court has declined to accept two questions certified by an Alabama federal court relating to the scope of duty owed by premises owners to non-employees and the causation standard when a plaintiff’s injury is a result of multiple exposures to asbestos.

In an order issued Aug. 24, the Alabama Supreme Court instead cited two prior cases: Sheffield v. Owens-Corning Fiberglass Corp., 595 So. 2d 443, 450 (Ala. 1992), and Owens-Corning Fiberglass Corp. v. Gant, 662 So. 2d 255, 256 (Ala. 1995).
