JPML Refuses to Vacate Transfer Orders in Cases Involving Biomet’s M2A Magnum Hip Implant

WASHINGTON, D.C. –– The Judicial Panel on Multidistrict Litigation has refused to vacate transfer orders entered in cases involving Biomet’s M2A Magnum Hip Implant, saying that transfer was appropriate.

In the Aug. 7 order, the U.S. Judicial Panel on Multidistrict Litigation in part rejected arguments that because the underlying plaintiffs were not eligible for the master settlement agreement, the claims should not be litigated in the MDL.

Plaintiffs in both Moise v. Biomet Orthopedics (No. 15-1023, E.D. La.), and Salemy v. Biomet Inc., et al., (No. 15-11502, D. Mass.) moved the panel to vacate the transfer orders. The plaintiffs in …
