DePuy ASR Hip Implant Plaintiff Moves for Preferential Trial Setting, Cites Declining Health

SAN FRANCISCO –– A plaintiff with claims pending in California’s coordinated docket for DePuy ASR hip implant litigation has moved for a preferential trial setting, saying his health is declining and that he is not expected to survive beyond six months.

In the Aug. 7 motion, the plaintiff asked the California Superior Court for San Francisco County to set the trial before Jan. 24, 2016.

“As the only plaintiff,” the motion stated, “he undeniably has a substantial interest in the action …. Should [the plaintiff] pass away before this action is brought to trial, his recovery will be greatly diminished, …
