Section 2601 Allegations Stricken From N.Y. Superstorm Sandy Coverage Complaint

MINEOLA, N.Y. — A New York state judge has stricken from a Superstorm Sandy coverage complaint allegations that the insurer violated Section 2601 of the New York Insurance Law, explaining that such claims should be addressed by the state insurance superintendent, rather than private litigants.

In an order entered Aug. 4, Judge Dana Winslow of the Nassau County Supreme Court also denied plaintiffs leave to amend their complaint, ruling that the allegations will then set forth claims under breach of contract, which have already been pled.
