Louisiana Court Refuses to Exclude Testimony of Decedent, 2 Defense Experts in Asbestos Suit

NEW ORLEANS –– A Louisiana federal court has denied motions to exclude testimony from both sides in an asbestos case, first finding that the testimony of the decedent should not be excluded since an insurer that was present for the deposition had a similar interest as an insurer that was not there.

In a separate order also issued on June 18, the U.S. District Court for the Eastern District of Louisiana also denied plaintiff efforts to exclude the testimony of two defense experts, saying the plaintiffs’ challenges went more to the merits of the case than the admissibility of the …
