Louisiana Court Awards Summary Judgment to Defendants in Benzene Case; Says Plaintiffs Can’t Prove Causation

NEW ORLEANS –– After issuing orders tossing testimony of a number of benzene plaintiff experts, a Louisiana federal court has concluded that the plaintiffs cannot prove causation and awarded the defendants summary judgment on the claims.

In the June 29 order, the U.S. District Court for the Eastern District of Louisiana said that the plaintiffs have not offered any admissible evidence on general causation and, as such, cannot present evidence on specific causation.

“Thus, plaintiff cannot make the requisite showing on causation,” the court concluded. “Accordingly, the Court grants defendants’ motion for summary judgment.”
