Texas Federal Judge Sets Aside Default Judgment for Plaintiff in Spinal Fusion Device Case

DALLAS — A Texas federal judge has set aside a default judgment entered in a plaintiff’s favor in a spinal fusion device case, ruling that X-Spine Systems Inc. has raised a meritorious defense to the claims and, as such, “allowing the case to proceed on the merits will not be an exercise in futility.”

On June 24, Judge Barbara M. G. Lynn of the U.S. District Court for the Northern District of Texas further found the plaintiff will not be prejudiced if the default judgment is set aside.
