Calif. Judge Defers Ruling on Plaintiffs’ Bid to Alter Lumber Liquidators Formaldehyde Test Program

SAN FRANCISCO — A federal judge presiding over 20 related Lumber Liquidators flooring class actions in California has declined to rule on challenges to an air testing kit program designed by the company to evaluate formaldehyde levels in customers’ homes.

In a May 15 order, Judge Jon S. Tigar of the U.S. District Court for the Northern District of California stated that he would defer ruling on two motions to modify the program because they raise issues that are central to more than 100 other similar class actions pending nationwide.
