JPML Refuses to Vacate Transfer Order of DePuy Pinnacle Hip Implant Suit

WASHINGTON, D.C. –– The Judicial Panel on Multidistrict Litigation has denied a plaintiff’s motion to vacate a conditional transfer order to the Pinnacle MDL docket in Texas, finding that a pending motion to remand the case was not enough to block the transfer.

In the April 2 order, the JPML ruled that the transferee judge –– the Hon. James E. Kinkeade –– could rule on the plaintiff’s efforts to have his claim be heard by a state court.
