Reinsurance Communications Sought in Coverage Dispute Not Discoverable, Ind. Judge Rules

INDIANAPOLIS — Reinsurance documents sought from a non-party reinsurer in a coverage dispute are not discoverable because they would not aid the court in construing potentially ambiguous terms in the policy at issue, an Indiana federal magistrate judge has ruled.

On April 7, Magistrate Judge Tim A. Baker of the U.S. District Court for the Southern District of Indiana explained that only reinsurance communications that discuss a contested policy would be relevant to construe an ambiguous term and are, as such, discoverable.
