Calif. Court to Weigh Protective Order Related to Lumber Liquidators’ Testing Program

SAN FRANCISCO — A California judge will consider arguments on a motion for protective order that plaintiffs in the Lumber Liquidators flooring litigation say is needed to prevent consumers from potentially waiving their rights to sue when they order home test kits to measure formaldehyde emissions in their residence.

In an April 17 order, U.S. Dist. Judge Jon S. Tigar denied efforts by Lumber Liquidators to extend the time for responding to the plaintiffs’ request until after the Judicial Panel on Multidistrict Litigation decides whether to consolidate similar cases filed around the country.
