Miss. Silica Plaintiffs Ask Trial Court To Reconsider Order Dismissing Claims, Call for Judge’s Recusal

LAUREL, Miss. –– Plaintiffs whose silica exposure claims were recently thrown out by a Mississippi judge have moved for reconsideration, arguing in part that the trial judge ignored evidence questioning whether there were feasible design alternatives to the respirator blamed for causing the alleged injuries.

In a separate motion, also filed April 7 in the Mississippi Circuit Court for Jones County, the plaintiffs made an additional request that Judge Dal Williamson recuse himself from the case, citing his prior involvement as counsel for an asbestos defendant in a case involving the uncle of the silica case’s plaintiffs’ counsel.
