Plaintiffs’ Expert Barred From Testifying As To Whether Pioneer Followed GAAMP in its Use of Pesticides

HONOLULU — A Hawaii federal judge has ruled that a plaintiffs’ expert may not testify as to whether a defendant followed Generally Accepted Agricultural and Management Practices in its use of chemicals on genetically modified crops in a pesticide exposure case, finding it is irrelevant to the plaintiffs’ property damage claims.

In a Jan. 13 order, Judge Leslie E. Kobayashi of the U.S. District Court for the District of Hawaii ruled, however, that the expert may present testimony regarding dust emissions to the extent that it may have affected plaintiffs’ property.
