NEW ORLEANS — A Louisiana federal judge has denied Allstate Insurance Co.’s motion for summary judgment in a Hurricane Isaac flood damage lawsuit, finding a question of fact exists as to whether the policyholders submitted adequate documentation to make out a valid claim under their Standard Flood Insurance Policy.
On Jan. 5, Judge Sarah S. Vance of the U.S. District Court for the Eastern District of Louisiana found the plaintiffs’ submission of an affidavit from their public adjuster creates an issue of fact, despite the fact that the adjuster cannot locate plaintiffs’ estimate.
