Hawaii Court Refuses to Reconsider Ruling Limiting Expert Testimony in Pesticide Exposure Suit

HONOLULU –– A Hawaiian federal court has refused to reconsider a ruling in which it limited plaintiff expert testimony in a pesticide exposure case, finding that the plaintiffs disagreement with the court’s findings is not a sufficient ground for reconsideration.

In the Oct. 31 opinion, the U.S. District Court for the District of Hawaii did note that if the plaintiffs re-designate the contested expert, and limit the scope of their testimony to the remaining property claims –– excluding reference to health and environmental effects –– the plaintiffs could use the limited portions.
