Calif. High Court to Review Question of State Court Jurisdiction Over Non-Residents’ Claims in Plavix Coordinated Proceeding




SAN FRANCISCO — The California Supreme Court has agreed to review the question of whether a state court has jurisdiction over claims brought by non-residents against Bristol-Myers Squibb Co. in a Plavix coordinated proceeding where the drug maker has engaged in substantial, continuous activity in California.

The high court granted BMS’s petition for review on Nov. 19. BMS is challenging a July ruling by the California Court of Appeal, 1st District, which found that the drug maker’s activity is substantially connected to claims by non-residents, which are based on the same alleged wrongdoing as those alleged by resident plaintiffs.
